1. Acceptance of Terms

By accessing or using CyberGhost VPN ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including visitors and registered subscribers.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify registered users of material changes via email.

2. Description of Service

CyberGhost VPN provides a Virtual Private Network service that encrypts your internet connection and masks your IP address. The Service is provided on a subscription basis and includes:

• Support for up to 7 simultaneous device connections
• Unlimited bandwidth with no data caps
• 24/7 customer support
• Applications for all major platforms

3. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

One subscription may be used by one individual user on up to 7 devices simultaneously. Account sharing with multiple individuals outside your household is not permitted.

4. Subscription and Payment

4.1 Billing

Subscriptions are billed in advance for the selected period (monthly, 6-monthly, or 26-monthly). By providing payment information, you authorize us to charge the applicable subscription fee. All prices are in US dollars unless otherwise stated.

4.2 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will receive a renewal reminder email prior to renewal. You can cancel auto-renewal at any time from your account settings.

4.3 Money-Back Guarantee

We offer a 45-day money-back guarantee on subscriptions of 6 months or longer, and a 14-day guarantee on monthly subscriptions. To request a refund, contact support within the guarantee period. Refunds are returned to your original payment method within 5–10 business days.

5. Acceptable Use Policy

You may use CyberGhost VPN for any lawful purpose. You agree not to use the Service to:

• Engage in any illegal activity under applicable law
• Distribute malware, spyware, or other malicious software
• Conduct denial-of-service attacks or network intrusions
• Send unsolicited bulk email (spam)
• Infringe the intellectual property rights of others
• Harvest personal data without consent
• Engage in any activity that violates third-party terms of service

Violation of this Acceptable Use Policy may result in immediate termination of your account without refund.

6. No-Logs Policy and Privacy

Our data collection and retention practices are governed by our Privacy Policy, which is incorporated by reference into these Terms. We maintain a strict no-logs policy — we do not monitor, record, or log your VPN activity, browsing history, or IP address while connected to our servers.

7. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. Scheduled maintenance, network issues, or circumstances beyond our control may cause temporary service interruptions. We will endeavor to provide advance notice of planned maintenance where possible.

8. Intellectual Property

All content, software, trademarks, and other intellectual property associated with CyberGhost VPN are owned by CyberGhost S.R.L. or its licensors. You may not reproduce, distribute, or create derivative works from our intellectual property without express written permission.

9. Limitation of Liability

To the maximum extent permitted by applicable law, CyberGhost shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability to you for any claims arising from the use of the Service shall not exceed the amount you paid for the Service in the preceding three months.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, uninterrupted, or free of viruses or other harmful components. We do not warrant that using the Service will guarantee complete anonymity in all circumstances.

11. Termination

You may cancel your subscription at any time through your account settings. We may terminate or suspend your account immediately, without prior notice, if you violate these Terms. Upon termination, your right to access the Service ceases immediately.

12. Governing Law

These Terms are governed by the laws of Romania and the European Union. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bucharest, Romania, except where mandatory consumer protection laws in your country of residence provide otherwise.
